Regarding the “non-compliance notice” issued by the Department of Labour around 2016 on occupational health and safety standards at the Nduli Primary School relating to the structural condition of the school buildings:

  1. Whether his Department is aware of the Department of Labour’s notice for an unsafe workplace; if so, what are the relevant details;
  2. (a) what actions were taken by his Department in response to the issues raised in the non-compliance notice and (b) what budget was allocated or is still to be allocated to address the identified structural and occupational health and safety defects at the school?
Answer Body: 
  1. The Department of Infrastructure (previously the Department of Transport and Public Works) has no record of a Department of Labour non-compliance notice issued in or around 2016 relating to occupational health and safety standards at Nduli Primary School. A review of available departmental records did not identify any documentation indicating that such a notice was issued to, or shared with, the Department.  The notice would ordinarily have been issued to the User Department of the building, namely the Western Cape Education Department (WCED), as the occupant and operator of the facility.
  2. (a)(b) As the Department of Infrastructure has no record of the Department of Labour notice referenced above, no specific actions were undertaken by the Department in response to such a notice, not was any budget allocated.

Note: This matter falls within the mandate of the Western Cape Education Department (WCED) and it is therefore recommended that this question be directed to WCED for a response.
