With reference to the reply to question 1 of 8 August 2025:

Given that erven 35172 to 35174 were excluded from the original land use management applications:

(a) (i) What is the current zoning status of these erven and (ii) what interim land use permissions apply to them, (b) what is the timeline for submitting a new or revised land use management application for the Racing Park erven now under “high-level best use” review and (c) how does his Department plan to reconcile the industrial zoning and security restrictions of Racing Park with the proposed introduction of residential or mixed-use developments?

Answer Body: 

 

  1. Erven 35172 – 35174 are currently zoned General Industrial 1 in terms of the City of Cape Town’s Development Management Scheme and can be developed in line with the Development regulations attached to this Zoning.  In addition, the land falls within the jurisdiction of the Racing Park Owners Association, so any development must comply with the provisions of their Constitution.
  2. The Department’s focus at the moment is to ensure the successful development of Phase 1 of the Killarney Gardens development, which land has already been serviced for development.  Engagements with the City of Cape Town are ongoing to facilitate implementation of Phase 1.  Phase 2 of the development, which includes all the remaining land owned by the Department through the HDA in this precinct remains on the Department’s project pipeline and detailed planning will proceed once Phase 1 commences and budget is made available for Phase 2 to proceed.  The planned development will be informed by the Best Use Study and will comprise the most economically feasible land use mix appropriate to the site.   
  3. The Conditions of Approval linked to the Rezoning to Subdivisional Area for this development dictates the interface between the planned residential development and the existing industrial precinct.  It includes the requirement for a wall to be constructed between the incompatible land uses, as well as limitations of the land uses to be constructed immediately adjacent to the industrial facilities.   These conditions came as a result of several engagements between the Department, Racing Park Owners Association and the City of Cape Town throughout the Rezoning approval process.   In addition, the Department is also in ongoing discussions with the Racing Park Owners Association to ensure that any planned future land uses meet the needs of the Department, while addressing any concerns that the Association may have.
