Police Oversight and Community Safety
(a) How many violations of protection orders were recorded in the province during the period 2020 to 2025, (b) how many (i) resulted in arrests, (ii) led to prosecutions and (iii) culminated in convictions, (c) how many police stations in the province currently have fully operational victim support rooms as required under the Domestic Violence Act, 1998 (Act 116 of 1998), and (d) what systems or mechanisms does the SAPS currently have in place to track (i) applications for protection orders and (ii) violations of protection orders?
(1) (a) 47 457 charges were registered for violating the conditions of a protection order.
(b) (i) 37 938 persons were arrested.
(ii) 37 938 accused persons were prosecuted.
(iii) 6 486 accused persons were convicted.
(c) All 152 police stations in the province have fully operational victim support rooms.
(d) (i) The South African Police Service (SAPS) provides the complainant with a J471E (Notice to Complainant in a Case of Domestic Violence Section 2(b) of the Domestic Violence Act, 1998 [Act No. 116 of 1998]), also referred to a Form 1, and explains its content to the complainant, including their right to apply for a protection order.
This interaction is recorded in the Occurrence Book (OB) with a corresponding CAS number if a case docket is opened, or alternatively, in the Pocket Book (SAPS 206) of the member attending to the incident or complaint. The subsequent tracking of the protection order application is undertaken by the Department of Justice and Constitutional Development (DoJ&CD).
(ii) Violations (contraventions) of protection orders are formally recorded when a criminal case is registered and captured on the SAPS Investigation Case Docket Management System (ICDMS).
