With regard to the 195 cases investigated by Provincial Forensic Services from 1 April 2019 to 30 June 2025:

  1. Whether copies of the investigation reports can be made available;
  2. (a) what amount of money was involved in each of the cases and (b) in cases where an official was found guilty of fraud and corruption, (i) how much money has been recouped from those cases, (ii) what actions did the departments take and (iii) where no actions were taken, what were the reasons;
  3. whether officials who were found guilty are they still employed by the departments; if so, what are the relevant details;
  4. whether departments take legal action against officials found guilty; if not, why not; if so, what are the relevant details;
Answer Body: 
  1. A forensic investigation report is issued to the accounting officer of a provincial department with the limitation that it is by its very nature, sensitive and classified as confidential and should not be discussed with or circulated to any external persons. It is important to note that forensic reports contain personal information and further processing thereof could be in contravention of the statutory processing limitation in terms of the Protection of Personal Information Act, No 4 of 2013.  Furthermore, the conclusion of a forensic investigation does not mean that the resolution of matters has been finalised or that all implicated parties or persons of interest necessary elected to respond to allegations during the forensic investigation. The resolution of these matters remains incomplete until the criminal issues have been finalized by the SAPS and / or the National Prosecuting Authority and/or court case, and the disciplinary issues by the internal processes of the relevant department.  As such implicated persons may decide to remain silent during the investigation and only respond to allegations at ensuing processes.  In order to provide for the rights of such individuals and protection of personal information, confidentiality is maintained at all times. Accordingly, investigation reports can unfortunately not be made available.

  1. From the information received during the investigation and follow up with departments on implementation of recommendations, none of such officials are are employed by departments.

 

Yes, when there is sufficient evidence to do so. A number of cases have been referred to the SAPS. For further details, please consult Annexure A
