The Standing Committee on Local Government, Enivornmental Affairs and Development Planning invites comments on the Western Cape Land Use Planning Amendment Bill [B 3–2025].

 

The Amendment Bill aims to update the Western Cape Land Use Planning Act, 2014 (Act 3 of 2014), about how land is used and developed in the Western Cape.

 

It includes changes such as:

 

  • Updating definitions to make the law clearer;
  • Improving the wording on how municipalities update their spatial development frameworks;
  • Removing outdated references to old planning documents;
  • Clarifying the term consistency in relation to spatial development frameworks;
  • Requiring municipalities to set validity periods on approvals for, for example, the rezoning or subdivision of land;
  • Changing how certain subdivision applications are handled;
  • Adjusting the provisions for removing or changing restrictive conditions contained in title deeds;
  • Giving municipalities additional options to set conditions when approving land use;
  • Removing the need for a bondholder’s consent in land use applications;
  • Simplifying the notice processes for land use applications;
  • Changing deadlines and procedures for government departments to comment on applications;
  • Improving how persons are notified about decisions on land use applications;
  • Streamlining authorisations in emergency situations and how the Provincial Minister can set conditions;
  • Improving the wording in specific sections of the Act;
  • Improving the coordination between different procedures and decisions; and
  • Including transitional rules to assist with the implementation of the Amendment Act.
