With reference to the approved municipal staff establishments and appointments of former opposition councillors to positions within the Cape Town Executive Mayor’s office:

In terms of the Local Government: Municipal Staff Regulations (“The Regulations”), read with section 66 of the Municipal Systems Act:

  1. (a) What are the details of the Council’s compliance, if compliant, with the Regulations and

(b) given that the Regulations allow for the Minister to submit comments, what are the details of his comments;

  1. Whether his Department raised any objections to the appointment of former opposition councillors; if not, why not; if so, what was the nature of the objections?
Answer Body: 

1.(a) The City of Cape Town (CoCT) has formally declared a dispute with National CoGTA with regards to concerns about the lawfulness and application of the Regulations and other relevant legislation. This dispute process has not yet been finalised and thus I do not intend to comment on the Council’s compliance in this regard.

(b) I have not yet commented on the staff establishments of the CoCT and will do so once the dispute has been resolved and the CoCT submits their structures for comment.

  1. The Department of Local Government does not comment or object to staff appointments within municipalities, except where such appointments fall under Section 56 or Section 57 of the Local Government: Municipal Systems Act, No. 32 of 2000.
