In respect of the sexual harassment allegation against Mr F Payne:
(1)(a) What is the detailed breakdown of actions taken to provide necessary support to the (i) complainant and (ii) victim, (b) what is the detailed breakdown of all measures taken to investigate and address the complaint against Mr Payne since the complaint was received to date, (c) what concrete steps did his Department take to protect and assist the victim;
(2)whether the victim is still working for his Department; if so, (a) in what capacity and (b) how is she being supported to ensure that she feels safe?

Answer Body: 
  1. The official who made the allegation instituted proceedings against the Department in the CCMA, which are pending, and it would hence not be appropriate to comment on the matter at this stage.
  2. The complaint was investigated internally, which culminated in a report and decision by the then Head of the former Department of Transport and Public Works not to initiate disciplinary action against Mr Payne, which is the subject of the proceedings before the CCMA.
  3. Refer to (a).

2. The official is still employed by the Department; (a) her capacity has not changed; and (b) shortly after submitting the complaint, the official was booked off and has not returned to work since then.
