  1. Whether the KSE Kraaifontein Tehuis has received any donations in the form of food items, non-perishable goods, clothing or hygiene supplies from individuals, private companies or NGOs during the period 2022 to 2025 to date; if so, (a) what are the details of the donors, (b) what were the quantities or types of donations received and (c) what was the intended use or distribution process of such goods;
  2. according to the national and provincial norms and standards for residential care facilities for older persons, (a) what categories of healthcare professionals are required to be present (e.g. doctors, professional nurses, caregivers and dieticians) and (b) what is the prescribed or recommended ratio of each category of healthcare professional to residents at an old-age home;
  3. whether the KSE Kraaifontein Tehuis currently has a dietician and/or a medical doctor on staff or under contract; if not, why not; if so, what (a) are their names, (b) are their qualifications, (c) is their scope of involvement, (d) is the frequency of their visits and (e) is the duration of their service;      
  4. (a) who are the current members of the Board of Directors of the KSE Kraaifontein Tehuis, (b) when were these board members elected or appointed and (c) what is the legal status of the current board in terms of compliance with the Nonprofit Organisations Act, 1997 (Act 71 of 1997), or other applicable legislation;
  5. whether the current board meets the minimum governance requirements, including a quorum and the number of board members?
Answer Body: 
  1. The Western Cape Department of Social Development does not maintain or investigate records of organizations that receive donations from individuals, private companies or other NGOS; however, organizations are encouraged to maintain records of all donations received in a donation register. Furthermore, DSD only investigates and monitor funds and goods obtained or provided with government funds.
  2. a) According to the national norms and standards for residential care facilities, the following nursing and other care and support staff are required to be present at the facility: Professional/Registered Nurse, Enrolled Nurse/Staff Nurse, Enrolled Nursing Assistant/ Nursing Assistants and Caregivers. The norms do not require a doctor or dietitian to be an employee/staff of the Home.

 

  1. The recommended ratio is as follows:

Firstly, in the facility there are residents classified as:

  • Category 1: Independent older persons who needs no assistance or have no health-related concerns.
  • Category 2 residents: older persons who are partially independent, with or without assistive devices and who need some form of supervision and assistance with their activities of daily living.
  • Category 3 residents (frail care): older persons in need of 24-hour care services.
  • In terms of National Norms and Standards regarding the acceptable levels of services to Older Persons and Service Standards for Residential facilities, older person in category 2 requires a minimum of nine (9) hours of care per week, while category 3 resident requires a minimum of 18 hours of care per week
  • To calculate the number of nursing and caregiver staff required for the number of residents, the following formula is used and is based on the following principles:
  • Number of hours staff work per week, ie. 40 hours
  • Number of days the service will be offered
  • Number of residents in the category
  • Number of hours of care required per week per resident.

For example, in the case of 30 residents:

Cat 3 =18h/week. Staff work on average 40h/week. 30x18/40.

33% must be Registered Nurses (thus 13.5x33%=4.45).

From the 4.45 half may be Enrolled Nurses (EN). Thus, about two Registered Nurses and two Enrolled Nurses

66% Enrolled Nursing Assistants (ENA); thus 13.5x66%=8.9, 50% may be Caregivers. Thus, roughly 5 ENAs and 4 caregivers.

  1. KSE does not have a medical doctor or a dietician on staff since the Act and regulations do not require this, however, the Home does refer their clients to the local clinic and day hospital for medical assistance. A registered dietitian from the Department of Health & Wellness has authorized the menu.
  2. a) The Board of Directors are Mr Earnest Smith, Mr Mark Gaffley and Mr Gerrit Smith. In terms of the Facility Constitution, Facility Manager and Finance & Administration Manager will be ex officio members, who will have full status as board members and will be enrolled to participate in any debate/discussion and vote on any matter before the Board, except in matters which relate to them.

b) The current Board Members were elected in 2019.

c) The organization is neither compliant with the NPO Act nor its own constitution, as it has failed to conduct its Annual General Meeting. According to the KSE Constitution, Annual General meeting must take place bi-annually (every second year).

  1. The Executive Board is composed of five members, with the option to add an additional three or two members if necessary. At KSE Tehuis, there are three active members, as opposed to the five that are necessary. The quorum of the board meeting is fifty percent of the Board members with voting rights.
