With regard to the recent human settlement project on erf 448 in Nyanga East:
- Whether any investigation was conducted into the reasons for the delays that took place on the site; if not, why not; if so; what are the relevant details;
- (a) what is the number of units that are illegally occupied and (b) what is the impact of the illegal occupation on the project;
- whether his Department conducted an investigation into the reasons for the illegal occupation; if so, what are the relevant details?
- Kindly note the correction: Erf 8448 instead of Erf 448, Nyanga. Yes an investigation was concluded. The contract of the previous contractor was terminated due to poor performance. The appointment of the original contractor was made from the Framework of Contractors, as per procurement regulations. The contractor’s head office was, however, in another province, with what transpired as limited resources in Cape Town. This lead to cashflow constraints, resulting in delivery delay, exacerbated by the Covid pandemic. Consequently, the contractor failed to complete the work, and the Department terminated the contract. With the mutual agreement of the Department and City of Cape Town, the City then took over the project in its entirety and appointed a new a contractor in March 2024. Progress on site is now deemed satisfactory.

(b)Consequently no negative impact was due to illegal occupation.
- There was no illegal occupation on Erf 8448. As a consequence, the Project Management Office of the Department is not aware of any investigations regarding this matter.
