[1] What is the basis upon which the Tafelberg property was classified as “surplus”, thereby justifying the disposal to private investors;

[2] whether an alternative use of this property by another national, provincial or municipal department was considered; if not, why not; if so, what are the relevant details;

[3] whether the notice period between 11 December 2015 and 2 January 2016 facilitated a satisfactory opportunity for public comment in light of the public interest in the disposal of state-owned property; if not, why not; if so, what are the relevant details?

Answer Body: 

4(1) The Tafelberg property was rendered surplus as defined in GIAMA, by operation of law, when it no longer met the needs of the Education department.

4(2) Yes. GIAMA specifies that, prior to the disposal of any property, other users, as defined by the prescribing legislation, must be consulted. This was done.

4(3) Yes. This notwithstanding, given certain complaints that have been made in High Court proceedings on this matter, of which we have taken cognizance, a fresh opportunity for comment has now been offered .
