Questions and Replies

The right of Members to put questions to Ministers is an important part of ensuring the executive authority’s accountability to the Provincial Parliament. Questions may be put to Ministers related to their spheres of responsibility. Replies to questions are either given orally in the House or in writing. The replies to oral questions are recorded in Hansard.

(1)    Whether a full forensic investigation was conducted into the financial affairs of the school as recommended by the investigators; if not, why not; if so, what are the relevant details;

(2)    whether there is any form of protection that teachers facing allegations of corruption and maladministration enjoy from WCED policies; if not, why not; if so, what are the relevant details;

(3)    (a) what are the full details of all the actions taken by her Department to recover the funds that are still in possession of this person and (b) what (i) is the total amount of funds that have been recuperated to date and (ii) are the measures put in place to prevent further corruption by principals at schools in the province;

(4)    (a) what are the details of the negotiations to recover the funds from this person and (b) what is the timeline to recover the funds that was illegally paid to her;

(5)    whether the matter of financial mismanagement and misconduct was reported to the South African Council of Educators after the disciplinary process was concluded by the WCED; if so, (a) what are the relevant details and (b) when was it reported?

With regard to the assault by a teacher, whose name has been furnished to her Department for the purpose of the reply, at the Sans Souci Girls’ High School:

(1)    (a) What remedial action was implemented by her Department in response to this incident and (b) what are the detailed steps and timelines of the action;

(2)    whether her Department laid charges of assault against this person with the SAPS; if not, why not; if so, what are the relevant details;

(3)    whether her Department applied for an interdict against this person to prevent her from having access to the school; if not, why not; if so, what are the relevant details;

(4)    whether her Department laid charges against the teacher with the South African Council of Educators (SACE); if not, why not; if so, (a) what are the details of the charges laid, (b) on which date the charges were laid and (c) what is the SACE reference number?

With regard to the investigation into the alleged fraud and financial misconduct by the former principal of the Golden Grove Primary School:

(1)    (a) What were the start date and end date of the investigation by her Department into the matter, (b) what were the detailed timelines of when the matter was first raised with her Department and when it was actually investigated, (c) what was the date when the investigative report was (i) finalised by her departmental officials and (ii) presented to the school community, including the principal and school governing body, (d) what was the date on which a certain person, whose name has been furnished to her Department for the purpose of her reply, submitted his resignation and (e) what was the resignation effective date;

(2)    whether her Department informed the South African Council of Educators of the findings brought to light by the internal investigation conducted; if not, why not; if so, what are the relevant details;

With reference to the issuing of clearance certificates to law enforcement officers (LEOs) in the metropolitan area:

(1)    (a) What is the process for the issuing of such certificates to LEOs, (b) which stakeholders, across the spheres of government, are responsible for the facilitation of this process, (c) what requirements must be met in order for an LEO to be provided with the certificate, (d) how many clearance certificates have been issued in (i) 2017, (ii) 2018, (iii) 2019, (vi) 2020 and (v) 2021 to date and (e) what is the turnaround time for the issuing of clearance certificates once they are submitted to the SAPS;

(2)    whether any backlogs were experienced in the time frame indicated in (d); if so, (a) how were these eradicated, (b) which stakeholders supported the eradication of backlogs and (c) what were their roles therein?
