The right of Members to put questions to Ministers is an important part of ensuring the executive authority’s accountability to the Provincial Parliament. Questions may be put to Ministers related to their spheres of responsibility. Replies to questions are either given orally in the House or in writing. With reference to the escalation of non-COVID-19 services at provincial hospitals after the fourth wave:

(1) (a) What is the projected timeline for the completion of the escalation of non-COVID-19 services so that provincial hospitals may resume normal functioning, (b)(i) how many surgeries, if any, were postponed during the fourth wave as a result of the de-escalation of non-COVID-19 services and (ii) what is the timeline for the eradicating the backlog with these postponed surgeries;

(2) whether any additional funding has been provided to hospitals in the province to eradicate the surgery backlog; if so, how much;

(3) whether there have been any non-COVID-19 treatments (other than surgeries) postponed as a result of de-escalating services; if so, what are the relevant details?

 With reference to the Department of Social Development’s strategic focus over the short- to medium-term period in the 2020/21 Annual Report and the implementation of the provincial Foster Care Management Plan:

(a) What is the total number of children in foster care in the province, (b) how many foster-care orders requiring extension are currently outstanding as a result of the foster-care backlog, (c) what are the main causes of the unprocessed extensions and (d) what is the expected timeline to eradicate the backlog?

With regard to the SAPS’s Cape Town Flying Squad: 

(1) (a) What is the (i) granted and (ii) actual number of vehicles allocated to the Flying Squad per district in the last three years and (b) how many of the vehicles             are in service; 

            (2) how many (a) staff members are employed at the Flying Squad and (b) are required to be on duty during any given shift;

           (3) how many cases of absenteeism has the Flying Squad experienced every month in the last three years?

The Premier recently confirmed that the Minister of Community Safety, Albert Fritz, was suspended based on allegations of “sexual misconduct”. In September 2019, Bonginkosi Madikizela, the former Minister of Transport and Public Works, the former Leader of Government Business and the former DA provincial leader, said in the legislature that the Western Cape Government has “a disturbing culture of sex for jobs, sex for tenders, sex for marks, etc” and that the Western Cape Government should “start by getting our house in order as government by protecting victims in our spaces”. With regard to this statement:

  1. (a) What has he done to address the “culture” described by former Minister Madikizela and (b) what is the process that an employee of the Western Cape Government must follow to report sexual misconduct, sexual harassment or sexual assault by a colleague or superior;

(2)  (a) how many employees from the (i) fifth and (ii) sixth parliament periods of the Western Cape Government have been reported for sexual misconduct, sexual harassment or sexual assault, (b) how many of these employees have been suspended pending an investigation or disciplinary hearing, (c) how many of these employees (i) have been prosecuted or (ii) are being prosecuted in a criminal court for sexual assault or any crime relating to sexual misconduct and (d) how many of those who have been or are being prosecuted have been suspended pending the finalisation of the criminal prosecution;

  1. why has a Provincial Treasury employee, whose name has been furnished to his Department for the purpose of his reply, who is currently being prosecuted for the sexual assault of a 7-year-old minor child, not been suspended;
  1. why has the Provincial Chief of Traffic, whose name has been furnished to his Department for the purpose of his reply, who is currently being prosecuted for the sexual assault of another employee of the Western Cape Government, not been suspended;
  1. how does the Western Cape Government intend to create an environment that is safe for victims of sexual misconduct for reporting their alleged perpetrators when the perpetrators are not suspended pending an investigation, hearing or trial?

With regard to the City of Cape Town’s Municipal Police Service, in terms of section 64(C)(2)(g) of the South African Police Service Act, 1995 (Act 68 of 1995), the executive head of the municipal police service must develop an annual police plan for the following financial year before the end of each financial year:

  1. Whether the Minister’s office received a plan for the financial year from 1 July 2020 to 30 June 2021; if not, what steps, if any, did the office take in terms of section 64 of the Act; if so, (a) when did the office receive the plan and (b) can a copy be provided;
  1. whether the Minister’s office received a plan for the financial year from 1 July 2021 to 30 June 2022; if not, what steps, if any, did the office take in terms of section 64 of the Act; if so, if so, (a) when did the office receive the plan and (b) can a copy be provided;
  1. if the City submitted an Annual Police Plan for each of the financial years mentioned above, whether each of these plans was approved by the Minister;
  1. whether any of the annual police plans includes references to the City’s Safety and Security Investigation Unit (SSIU); if so, (a) in which years was the SSIU included in the Annual Police Plan and (b) what were the role and functions of the SSIU as described in the annual police plans?

  1. Whether the land referred to is the land on which the Woodstock Hospital and the related buildings are built; if so, what are the relevant details;
