The right of Members to put questions to Ministers is an important part of ensuring the executive authority’s accountability to the Provincial Parliament. With reference to the reply to question 7 of 1 April 2021 and his budget speech on 16 March 2021 where he stated: “Today I am pleased to announce the six candidate municipalities participating in the Municipal Energy Resilience Project in this financial year”:

 

  1. Whether he can clarify the contradicting messages from the written reply and the budget speech; if so, what are the relevant details;

 

 

  1. (a) what is the breakdown of the R68,8 million allocated to beat loadshedding in accordance with the budget allocation of 16 March 2021, (b) how many megawatt will be secured with these funds and (c) by when will any of the participating municipalities be off the Eskom grid?

The contents of a media article dated 30 April 2021 with the title “Law and disorder: City of Cape Town’s special investigation unit head charged in cop fraud case” raise a number of questions about the lawfulness or legitimacy of the City of Cape Town’s Special Investigation Unit (SIU):

 

(1)        Whether he has conducted any enquiries into whether the City of Cape Town’s municipal police service complies with section 64E of the South African Police Service Act, 1995 (Act 68 of 1995); if so,

(2)        whether the City of Cape Town’s municipal police service is, in all respects, operating within the policing legislation; if so, what are the relevant details; if not,

(3)        whether he will be conducting an enquiry into the functions of the municipal police service performed or conducted by the City of Cape Town to assess that they comply with the relevant legislation; if so, what are the relevant details;

(4)        whether he made any specific enquiry or conducted any investigation into the functions of the City of Cape Town’s SIU; if not, why not;

(5)        given the media report, whether he will conduct an investigation or enquiry into the lawfulness of the City of Cape Town’s SIU and its functions; if so, what are the relevant details; if not,

(6)        whether he has engaged with the Provincial Police Commissioner on the allegations against the SIU and its head and/or its functions; if so, what was the outcome;

(7)        whether the City of Cape Town’s SIU conducted an investigation in 2016 into DA councillor candidates and produced a report on criminal convictions or criminal charges against some of them; if so, what are the relevant details;

(8)        whether the SIU has been involved in any investigation for political purposes; if so, what are the relevant details;

(9)        whether the SIU has been involved in any investigation that is outside the mandate of the municipal police service as provided for in the Act and/or the standards set by the national Police Commissioner; if so, what are the relevant details;

 

(10)      what process was followed for the appointment of the arrested SIU head by the municipal police service to head the unit?

(a) How many tenders for the maintenance of (i) schools and (ii) hospitals have been advertised since October 2019, (b) how many of these contracts were awarded to companies outside the Western Cape, (c) how many of these tenders require management contractors and (d) what is the CIDB grading required for these management contractors;

With reference to the reply to question 9 of 26 February 2021:

 

  1. (a) Of the 1 544 school listed on the Department’s User Asset Management Plan, how many schools have (i) libraries, (ii) computer rooms and (iii) science laboratories and (b) what has happened to the 95 schools unaccounted for in the response (1 067 primary schools and 382 secondary schools equal 1 449 schools but there are 1 544 schools in the province according to the Department’s User Asset Management Plan and therefore 95 schools are unaccounted for);

 

  1. (a) what budget has been made available to resolve the problems at the 78 schools that have been identified as constructed from “inappropriate material” and (b) what budget has been made available for repairs at the 22 schools in need of repair;

 

  1. whether children are still attending the schools in (2); if so, (a) what are the relevant details and (b) in which areas are these schools situated;

 

  1. (a) what budget has been made available for repairs and maintenance at the schools identified and (b) how many school buildings have been transferred to the Department of Transport and Public Works since 2009?
